Privacy Policy

This privacy policy applies to the web site nativeMsg.com and all of its features, and any other websites applications, widgets, interactive features or online services operated by nativeMsg, Inc. (“nativeMsg,” “we” or “us”) that post a link to or include this Privacy Policy (collectively, “nativeMsg Site”). .This privacy policy only applies to the nativeMsg Site, and does not apply to information collected offline or information that may be collected by our clients who use our technology solutions.

By using the nativeMsg Site, you consent to the collection and use of information by nativeMsg as described in this Privacy Policy.  Please review this Privacy Policy carefully. In addition, please review nativeMsg’s Terms of Use, which govern your use of the nativeMsg Site.

Information We Collect

In general, you can visit the nativeMsg Site without providing us with any information that identifies you as a specific individual, such as your name, mailing address, email address, phone number, or other information that identifies you as an actual person (“Personal Information”). However, certain features may ask you to provide Personal Information, including if you choose to register with the nativeMsg Site. We may also ask you to provide demographic information, such as ZIP code or information regarding preferences or hobbies (“Demographic Information”) or other information about you.  If you register with the nativeMsg Site, we will also ask you to create a user-name and password that will serve as your log-in credentials.  If we associate demographic and other non-personal information with Personal Information we will treat the combined information as Personal Information.

nativeMsg may also provide you opportunities to submit Personal Information about other individuals. For instance, you may choose to send an e-mail invitation to encourage a contact to try our services. We will not use the Personal Information of these other individuals for any other purpose unless we disclose otherwise at the time you provide the information.

We and our third-party service providers may use certain technologies (such as cookies and Web beacons) that automatically or passively collect certain information whenever you interact with the nativeMsg Site (“Usage Data”). Usage Data may include the browser and operating system you are using, the URL or advertisement that referred you to the nativeMsg Site, any search terms you entered into a search engine that led you to the nativeMsg Site, the areas within the nativeMsg Site that you visit and the time of day, among other information. Usage Data also includes the IP address or other unique identifier (“Device Identifier”) for any computer, mobile phone, or other device used to access the nativeMsg Site. A Device Identifier is a number that is automatically assigned to your device, and our servers identify your device by its Device Identifier. Some mobile service providers may also provide us with information regarding the physical location of the device you used to access the nativeMsg Site. Usage Data is generally non-identifying, but if we associate it with you as a specific and identifiable person, we will treat it as Personal Information.

We may also receive information about you from third parties and we may supplement the information we collect with outside records.  We may combine the information we receive from those other sources with information we collect through the nativeMsg Site. In those cases, we will apply this Privacy Policy to the combined information.

The nativeMsg Site is not intended for use by anyone younger than the age of 13 and we do not knowingly collect Personal Information from children younger than age 13. If we learn that we have in fact collected Personal Information from a user younger than 13, we will delete it from our records. 

Tracking Technologies

We and our third-party service providers, including third-party advertisers and analytics providers, may use the following or similar technologies to collect Usage Data whenever you visit the nativeMsg Site.

Cookies. “Cookies” and local storage are pieces of information (data files) transferred to a browser when the user visits a site. These technologies are able to store a unique identifier for a device to allow an online service provider to recognize the device whenever the device is used to visit the site. Web Beacons. Small graphic images or other web programming code called web beacons (also known as “pixel tags,” “1×1 GIFs,” or “clear GIFs”) may be included in our web pages and email messages. Web beacons may be invisible to you, but any electronic image or other web programming code inserted into a web page or email can act as a web beacon. Web beacons or similar technologies may be used for a number of purposes, including, to count users of the nativeMsg Site, to monitor how users interact with the nativeMsg Site, to count how many emails that were sent were actually opened or to count how many particular links were actually viewed.

Embedded Scripts. An embedded script is programming code that is designed to collect information about your interactions with the nativeMsg Site.  The code is temporarily downloaded onto your device from our web server, is active only while you are connected to the nativeMsg Site, and is deactivated or deleted thereafter.In addition, we may use a variety of other technologies that collect similar information for security and fraud detection purposes.

How We Respond to “Do Not Track” Signals

Please note that your browser settings may allow you to automatically transmit a “Do Not Track” signal to websites and online services that you visit. There is no consensus among industry participants as to what “Do Not Track” means in this context. Like many websites and online services, nativeMsg does not alter its practices when it receives a “Do Not Track” signal from a visitor’s browser. Social Network, Platform Integration, and Third Party Links

The nativeMsg Site may contain integration with social networks and other platforms. For example, you may have the opportunity to integrate your social media account with our chat functionality, to “like” or “share” the nativeMsg Site’s content to other online services, or display tweets or other content from third party platforms on the nativeMsg Site, in accordance with the terms of that third party platform. The nativeMsg Site also may contain buttons that direct users to our social networking pages (such as Facebook or Twitter).  Note that if you choose to “like” or “share” content, to integrate your accounts, or to otherwise post information via the nativeMsg Site to a third-party website or other online service, that information may be publicly displayed and the third-party website may have access to information about you and your use of the nativeMsg Site.

In addition, the nativeMsg Site may have links to third party websites. If you click on social networking buttons or third party links, you will be taken to those third parties websites, and your use of those third parties’ websites and platforms are subject to their privacy policies and practices. We are not responsible for the privacy or business practices of any third party.

How We Use Information About You

We will collect, hold, and use information about you (including Personal Information and Usage Data) for the purposes for which we collected it, and for other related purposes that you would reasonably expect.  Generally, these purposes include using information collected through the nativeMsg Site to: (a) enable you to use the nativeMsg Site and its features, and to provide related user service, including responding to your questions, complaints, or comments; (b) fulfill transactions and process orders and payments; (c) administer and develop our business relationship with you and the company you represent; (d) provide you with information, products or services that you have requested or agreed to receive or that we otherwise believe will interest you, including sending you information and special offers from us, including our affiliated or parent companies, and on behalf of our third party business partners; (e) tailor content, recommendations and offers we display to you, both on the nativeMsg Site and elsewhere online, (f) conduct internal analyses, such as surveys and market research, to improve the nativeMsg Site, our products and services, and for other internal business purposes; (g) process information you provide via the nativeMsg Site, including verifying that your e-mail address is active and valid; (h) contact you with administrative communications and, in our discretion, notice of changes to this Privacy Policy, our Terms of Use, or any of our other policies, (i) assess your employment application for a position with nativeMsg or an entity related to nativeMsg and prepare related governmental and internal statistics reports; and (j) for purposes disclosed at the time you provide your information, with your consent, and as further described in this Privacy Policy.

We may also use non-personal information, including information that has been de-identified (typically by using a mathematical process known as a “hash”), to make inferences about you and content you may be interested in, to serve you with relevant advertising, and to allow others to do so.

How and When We Disclose Information to Third Parties

nativeMsg may share non-Personal Information, such as Usage Data, de-identified, and aggregated user statistics, with third parties in our discretion. We do not share Personal Information with third parties for those third parties’ own direct marketing purposes.  We may share the information we have collected about you (including Personal Information) with third parties as disclosed at the time you provide your information, with your consent, as described in this Privacy Policy, and under the following circumstances.

Third Parties Providing Services on Our Behalf
We may share information about you, including Personal Information, with third-party vendors to enable them to perform services on our or your behalf.  For example, these third party vendors may host the nativeMsg Site, sending email or other communications, and provide us with marketing assistance and data analysis.

Sweepstakes, Contests and Promotions
We may offer sweepstakes, contests, and other promotions (any, a “Promotion”) that may require registration. If you choose to enter a Promotion, Personal Information may be disclosed to third parties or the public in connection with the administration of such Promotion, including, without limitation, as required by law or permitted by the Promotion’s official rules, such as on a winners list.

Administrative and Legal Reasons
We may also transfer and disclose user information, including Personal Information, to third parties: (i) in the event we are required to respond to subpoenas or other legal process or if in our opinion such disclosure is required by law; (ii) at the request of governmental authorities conducting an investigation; or (iii) to protect and/or defend the Terms of Use, or other policies applicable to the nativeMsg Site or to protect the personal safety, rights, property or security of nativeMsg, our users, or a third party.

Business Transfers
nativeMsg may share Personal Information with its parent, or its subsidiaries and affiliates, primarily for business and operational purposes. nativeMsg reserves the right to disclose and transfer all information related to the nativeMsg Site, including Personal Information: (i) to a subsequent owner, co-owner or operator of the nativeMsg Site or applicable database; or (ii) in connection with a corporate merger, consolidation, restructuring, bankruptcy, the sale of certain of nativeMsg’s ownership interests, assets, or both, or other company change, including, without limitation, during the course of any due diligence process.

Third Party Analytics Providers, Ad Servers and Similar Third Parties

We may work with network advertisers, ad agencies, analytics service providers, and other vendors to provide us with information regarding traffic on the nativeMsg Site (including pages viewed and the actions taken when using the nativeMsg Site), to serve, or assist us in serving, our advertisements on other websites, within mobile apps, and elsewhere online, and to provide us with information regarding the use of the nativeMsg Site and the effectiveness of our advertisements. For example, if you view or click on an advertisement for nativeMsg or one of our products, our service provider(s) may be able to tell us the advertisement that you clicked on and where you were viewing the advertisement.

These service providers may set and access their own tracking technologies on your device (including cookies and web beacons) and may otherwise collect or have access to information about you. Some of these parties may collect Personal Information over time when you use the nativeMsg Site or other online websites and services. We may share Usage Data or de-identified data about visitors with third-party advertising companies, analytics providers and other vendors for analytics and advertising purposes.

We use a variety of service providers to perform advertising services. Some of these companies are members of the Network Advertising Initiative (“NAI”) or the Digital Advertising Alliance (“DAA”) Self-Regulatory Program for Online Behavioral Advertising. You may also want to visit https://www.aboutads.info/choices/, which provides information regarding targeted advertising and offers an “opt-out” by participating companies in the DAA Self-Regulatory Program. Please note opting out through these mechanisms does not opt you out of being served advertising. You will continue to receive generic ads while online.

Your Choices

By providing us with your Personal Information, you consent to us using your Personal Information to provide you with promotional and marketing communications as set out above. You agree to receive such communications by post, phone or by electronic means (including e-mail). Email us at terms@nativemsg.com to opt-out from marketing communications.

You may opt out of receiving promotional and marketing emails from us using the opt-out mechanism included in the commercial emails we send. Please note that we reserve the right to send you certain communications relating to your use of the nativeMsg Site, service announcements, notices of changes to this Privacy Policy or our Terms of Use or similar administrative or transactional messages, and you may continue to receive these transactional account messages even if you choose to opt-out from marketing communications. We may provide additional opt-out options for marketing communications in those communications.

Updating Your Information

You are responsible for maintaining the accuracy of the information you submit to us, such as your contact information, either through any online account feature offered or by contacting us. You may access the Personal Information we hold about you by contacting our customer service department by email at terms@nativemsg.com.  In addition, at any time you can request that we modify or delete your Personal Information that we hold about you if you believe it is inaccurate, incomplete, out-of-date, irrelevant or misleading by sending an email to us at terms@nativemsg.com with the words “UPDATE MY INFORMATION” in the subject line.  Please be aware that, to protect your security and privacy, we may take reasonable steps to verify your identity prior to making changes to your Personal Information.  Generally, we will provide you with access, except in limited circumstances where the law permits us to deny access.

We will make good faith efforts to make requested changes in our active databases as soon as reasonably practicable (unless we are required by law not to do so).  Note, however, that information you update or change may persist internally or for our administrative purposes. It is not always possible to completely remove or delete all of your information from our databases, and residual data may remain on backup media or for other reasons.

When You Apply For a Job Through the nativeMsg Site

If you apply for a job through the nativeMsg Site, we, or a human resources company helping us out, may ask you to provide self-identifying information (such as veteran status, gender and ethnicity) in conjunction with laws and regulations enforced by the Equal Employment Opportunity Commission (“EEOC”), the Office of Federal Contract Compliance Programs (“OFCCP”), and similar state and local regulatory agencies.  Providing self-identifying information is voluntary, but if you do provide us with that information, we may submit it to the EEOC, the OFCCP and similar state and local regulatory agencies for business-related purposes, including responding to information requests, fulfilling regulatory reporting requirements and defending against employment related complaints.

Protection of Personal Information

We employ commercially reasonable security methods and technologies to help secure your Personal Information. However, no system can be guaranteed 100% secure. We therefore cannot ensure or warrant the security of any information that you transmit to us, or that we transmit to you, or guarantee that it will be free from unauthorized access by third parties. You use the nativeMsg Site and provide us with information at your own initiative and risk.

Consent to Transfer

We operate the nativeMsg Site from the United States. If you are located outside of the United States, please be aware that information we collect will be transferred to and processed in the United States and other jurisdictions. By using the nativeMsg Site, or providing us with any information, you fully understand and unambiguously consent to this transfer, processing and storage of your information in the United States and other jurisdictions, where the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen.

Changes to this Privacy Policy

We may modify this Privacy Policy from time to time in our sole discretion and any changes will be effective upon posting of the revised Privacy Policy unless otherwise specified. If there are material changes to the way we treat Personal Information, we will notify you by posting the updated Privacy Policy on the nativeMsg Site. We may also provide notice to you in other ways in our discretion, such as through contact information you have provided. Your continued use of the nativeMsg Site following the updated Privacy Policy will mean you consent to those changes.
