(“nativeMsg” “we” or “us”) is a service provider that helps its clients communicate with their consumers online (the “Platform”), and in doing so, we collect certain information on behalf of our clients The purpose of this privacy policy is to help explain to our clients and partners how we collect, use, and disclose such information through our Platform.

We are not responsible for the privacy or security practices of our clients, which may differ from those set forth in this policy. To understand how our clients will use your personal information, please refer to the relevant privacy policies for those clients with whom you interact and have a relationship.

Our Platform:

Our Platform helps clients communicate with their consumers, improve the consumer experience, and market their products and services.

The NativeMsg Platform enables our clients to: 

  • Communicate with their consumers through the applications and other online services.
  • Gain insight into how their products and services are used through real-time consumer feedback.
  • Use conversational commerce to interact directly with consumers through the clients’ marketing and advertisements.
  • Present offers about client products and services to consumers.

Information We Collect:

We collect information from users on behalf of our clients through the Platform (“Usage Data”), which includes information about your device and how you interact with our clients, and may include information that you enter while using an online chat function offered through the Platform by one of our clients.  nativeMsg does not have any direct relationship, contractual or otherwise, with end users of our clients and their apps, websites and online services, and the client maintains these relationships.  .

Some of the Usage Data we may be considered “personal information” under various applicable laws. We consider information that identifies you as a specific, identified individual to be personal information (such as name or email address), and we treat additional information, including IP addresses, as “personal information” where required by applicable law. Please note that we do not collect personal information when the Platform is used via the Google Display Network.

If we combine information we consider to be non-personal with personal information, we will treat that combined information as personal information under this Privacy Policy and as required by law. Note that we may de-identify personal information so that it is non-personal, such as aggregating it or converting it to a code, sometimes using a function commonly known as a “hash”. We will treat de-identified information as non-personal, and may use or disclose such non-identifying, non-personal information for any purposes that we deem appropriate, to the fullest extent allowed by applicable law.

The Usage Data we may collect includes:

  • Information about your device, such as the IP address and unique identifiers assigned to your device (e.g., iOS Identifier for Advertising (IDFA), Android Advertising ID (AAID or GAID).
  • Information about your online behavior, such as information about the activities or actions you take and content you view when clients use our technology, such as time spent interacting with a client application, how you interact with an ad or a mobile app, session start/ stop time, and geo-location data.
  • Information provided through chat functions, such as questions you asked about a client product or service, transaction history, and personal information you submit to our clients. We do not collect personal information or any questions you ask when you use our chat functions within the Google Display Network.
  • Information about ads served, viewed, or clicked on, such as the type of ad, where the ad was served, whether you clicked on it and the number of times you have seen the ad.

How We Collect Usage Data

We may use standard web technologies to collect Usage Data, including the following.

APIs. APIs are programming codes that collect information about your interactions with websites and applications.  

Local Storage. We may collect and store information (including personal information) locally on your device using mechanisms such as browser web storage (including HTML 5) and application data caches. nativeMsg does not utilize these local storage tools when providing the Platform through the Google Display Network.

How We Use Your Information

  • To provide the Platform to our Clients. Generally, we use the information we collect about you to help our clients use the services, including to engage in an online chat with users, to better understand their customers and prospective customers, and to build better consumer experiences.
  • For legal compliance and related purposes::We will use information collected in accordance with applicable law comply with legal process and obligations; to respond to requests from public and government authorities including public and government authorities outside your country of residence; to enforce our terms and conditions, contracts or other applicable polices, and to defend or pursue legal claims; and to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others.
  • For administrative and internal business purposes: We use information collected for internal business purposes in accordance with applicable law, such as internal analysis, research and development, accounting purposes, and improvement of the Platform.  

How We Share Your Information

  • Clients and at the Direction of Our Clients. We share Usage Data with our clients and to third parties as directed by our clients.  
  • Third Parties Providing Services on Our Behalf or on Behalf of Our Clients. Third parties who provide services to us or our clients may have access to information, including information about you, in order to perform services for us or on behalf of our clients. Examples include: technical, operational, or hosting support, software development tools, and security services.
  • Administrative and Legal Reasons. We may transfer and disclose information, including Usage Data, to third parties: (i) to respond to subpoenas or other legal processes or if in our opinion the disclosure is required by law; (ii) at the request of governmental authorities conducting an investigation; or (iii) to protect the safety, rights, property or security of us or any person or entity.
  • Business Transfers. We may disclose and transfer information, including Usage Data: (a) if we assign our rights regarding any of the information to a third party or (b) in connection with a corporate merger, consolidation, restructuring, sale of certain of nativeMsg ownership interests, assets, or both, bankruptcy or other corporate change, including, during the course of any due diligence process.

International Transfers

nativeMsg is a United States company and we operate the Platform from the United States. If you are located outside the United States, please be aware that information we collect will be transferred to and processed in the United States or other jurisdictions around the world. By using the Platform, or providing us with any information, you fully understand and unambiguously consent to this transfer, processing and storage of your information in the United States and other jurisdictions where the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen. In certain circumstances, your personal information may also be subject to access by and disclosure to law enforcement agencies under the applicable foreign legislation.

Your Privacy Choices with Regard to Online Targeted Advertising  

Our clients may use our Platform in connection with their online advertising activities, they may use a variety of third parties to perform targeted advertising services. These companies may be members of the Network Advertising Initiative (“NAI”) or Digital Advertising Alliance (“DAA”), which offer choices with regard to certain targeted advertising activities. You may wish to visit optout.networkadvertising.org, which provides information regarding targeted advertising and the opt-out procedures of NAI members. You may also want to visit optout.aboutads.info, which provides information regarding targeted advertising and offers an opt-out for participating companies.

For mobile apps, you can typically limit ad tracking using the settings on your phone, tablet or other mobile device using the “Ads” menu, “Ad Tracking” setting, or similar setting on your device. Mobile device operating systems such as Apple iOS or Google Play Services provide mechanisms that allow users to opt out of the use of information about their usage of mobile apps to deliver targeted ads based on their interests. For more information, or to opt out using these mechanisms, consult your device settings (“Opt out of Interest-Based Ads” or “Opt out of Ads Personalization” on Android devices and “Limit Ad Tracking” on iOS devices). Please be aware that opting out does not mean that you will no longer receive targeted marketing messages in your mobile apps or Web browsers. You may still receive generic advertisements and you may see targeted advertisements based on information collected and used by entities other than us.

Changes to this Platform Privacy Policy

To the extent allowed by applicable law, nativeMsg may update or supplement this Privacy Policy from time to time. We will notify you of material changes by posting the changed or modified Privacy Policy on the Platform. Any changes will be effective upon posting unless otherwise indicated. We may also notify you in other ways, such as by email, at our discretion. Your continued use of the Platform after the effective date of the revised Privacy Policy (or other act as specified in the revised Privacy Policy) will constitute your consent to those changes to the fullest extent allowed by applicable law. In the event that there are material changes to the way we treat previously collected personal information, we will provide notice and obtain your consent (opt-in or opt-out), if required by law. Note that you may need to consent to our new policy in order to continue to use the Platform.
